The FTC recently announced the start of its decennial review of the FTC's Mail and Telephone Order Merchandise Rule.(16 CFR Part 435). The Commission seeks comments on whether to retain the rule and if so whether the rule needs to be changed in response to technology and marketing practices that have taken place since the last update in 1993.
Among the changes would be a clarification of the rule's application to goods ordered by computer and/or the internet as well as application to goods ordered through new payment methods. Also under consideration is whether changes should be made to make for more flexibility in handling refunds. A list of specific questions is part of the FTC materials.Comments are due by November 7
